Department of Labor Overtime Rules April 21, 2004 The Department of Labor (DOL) yesterday released the final rules related to Part 541- Reform (Overtime Rules). The final rules excluded the controversial language that originally included “Armed Forces Training” as a provision that would exclude a veteran from receiving overtime and reclassifying his/her position as a professional position. Just as important, the new rules not only omit “Armed Forces Training” but goes so far as to directly mention “thus, a veteran who is not performing work in a recognized professional field will not be exempt, regardless of any training received in the armed forces.” As you may recall, VVA was the only VSO to challenge DOL proposed rules. The other VSOs either agreed with DOL or remained silent. VVA sent formal comments and several letters to Secretary Elaine Chao and others complaining that the proposed rules as previously written would harm veterans and we did not support the changes. VVA also attended several meetings with other interested parties to form alliances to defeat the proposed rules. Thus, the final rules were released yesterday and VVA along with other VSOs attended a special briefing by DOL executives to update us on the positive changes. We would like to thank many of the concern VVA members who kept abreast of this issue and gladly acknowledge Rick Weidman’s leadership on this important matter.
